It has come to our attention that witnesses have explicitly referred to their actual size or the size of other witnesses as part of the team’s strategy in presenting the case (for example, “see how small I am, how could I have done that?”). The Mock Trial Executive Committee has concluded that this is an unfair extrapolation and outside the spirit of the competition. The extrapolation is unfair since the fact of the witness’ physical stature is not in the witness statement. Furthermore, this “fact” is not uniformly available to every team, since teams will present witnesses of varying sizes and of different genders.
Thus, under our rules, an objection, with reference to this statement, is sufficient to prohibit a witness from making specific reference to her/his own physical traits or physical traits of other witnesses not included in any witness statement, as well as prohibit an attorney from making argument pointing out the same. No team should make this extrapolation from this point on in the competition (i.e. for all trials commencing on or after February 7, 2008.)
This ruling is limited to a witness’ own reference to his/her own traits or traits of other witnesses, and counsel’s argument of the same. This ruling is not meant to prohibit teams from raising issues about general or common human traits and abilities relevant to the case.
